TERMS OF USER AGREEMENT

This User Agreement describes the terms and conditions applicable to users who wish to use the services and resources offered by Text Sales, Inc.  Terms “we”, “our”, “NGCSUBOOKS”, “NGCSUBOOKS.COM” and “Text Sales, Inc.” refer to all resources, websites and sub domains of NGCSUBOOKS.COM, owned by Text Sales, Inc., a Georgia registered corporation.  Text Sales, Inc.  Thoroughly read the User Agreement and Privacy Policy before becoming a member on NGCSUBOOKS.COM. We reserve the right to make changes and amendments to our policies and services without written consent from the user. All proposed amendments will be available for viewing on our website and a notification will be emailed to registered users when they become available.  If you are not in agreement with any of the amendments, you may terminate your membership with us before, during, or after the amendment goes in effect.  This user agreement cannot otherwise be amended except in writing, signed both by the user and Text Sales, Inc.

VENUE

VENUE TERMS

NGCSUBOOKS.COM is an online venue for trading books and does not fall under definition of an auctioneer.  We provide resources for users to trade in an “auction-style” format, but are not involved with either the buyer or seller, do not have any input on pricing of an item, and do not have legal ownership of any item at any given point of the transaction.  We do not and cannot promise, on behalf of the buyer or seller, that they will complete a transaction as agreed upon between the members.  We also do not assume liability of the quality, safety, or legality of any item listed on the site.  However, precautionary steps are taken to verify the users and their information to protect our users.

RELEASE AND LIABILITY

Since we are only a venue, in the event of a dispute among one or more users on NGCSUBOOKS.COM, you release TextSales, Inc. and all employees and/or officers of TextSales, Inc. and its affiliates, from any claims, demands, damages of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, resulting from or in any way associated with these disputes.

INFORMATION

We do not control information available on our website from users.  As a result, information may be offensive, harmful, deceitful, or inaccurate.  By agreeing to these terms for our site, you accept these risks. If you do find anything offensive, harmful, deceitful or inaccurate we suggest that you report to TextSales, Inc., however we do not guarantee to take an action as proposed by your report.

MEMBER TERMS

MEMBERSHIP

Your membership account and any or all applicable parts of your account, such as your username, password may not be sold or transferred to any other party for any reason.  From this point on, let it be known that the term username and password are referring to the same entity on any or all TextSales, Inc. material, including anywhere on this site, www.NGCSUBOOKS.com.

MEMBER ACCOUNT

If you choose to sign up as a member with TextSales, Inc., you will be asked to create a username and password that will allow you to access your account.  It is your responsibility to maintain the confidentiality of your account and you will be held responsible for all activities that occur within your account. TextSales, Inc. does not ask for your sensitive information, such as password, credit card number, or bank account number through email.  Forward any suspicious looking emails asking for such information to Support@ngcsubooks.com. As a member, it is your responsibility to immediately notify TextSales, Inc. of any unauthorized use of your account.  TextSales, Inc. cannot and will not be held liable for any loss or damage as a result of your failure to comply with previously stated terms.

IDENTITY VARIFICATION

TextSales, Inc. does its best to verify the identity of all users.  However, since verifying identity on the Internet is a difficult task.  It is the responsibility of the user to verify credibility of other users.  TextSales, Inc. only verifies that member names appearing on our website are valid and active members of NGCSUBOOKS.COM.

FEES AND SERVICES

NGCSUBOOKS.COM is completely free to use.  The buyer and seller are responsible for shipping and completing a transaction.

AFFILIATION

USER AFFILIATION

TextSales, Inc. and you are independent contractors, and no agency, affiliation, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this agreement, even through the referral program.

ADVERTISORS AND THIRD PARTY AFFILIATION

TextSales, Inc. does not hold any responsibility for any material directly or indirectly posted by an advertiser or any other third party.  This includes material found by following any third party links from our website. You must contact the third party involved in case you find any such material posted that may conflict with your interest with and beyond our website.

BIDDING

BIDDING TERMS

As a buyer, you are obligated to complete any transaction for an item.  You become the eligible buyer of the item by bidding or other means, provided the bid meets the minimum bid posted, and the item listed does not violate any terms listed in this agreement or is unlawful in your geographical area.  You become the legal owner of an item upon physical receipt of the item, unless both you and the seller come to another agreement.

SELLING

LISTING

You must be legally able to sell items that you list on NGCSUBOOKS.COM. All listed items must be in an appropriate category and contain only information pertinent to the item listed.  You are responsible for any legality associated with the sale, including, but not limited to, all applicable taxes.  In addition, any images submitted with a listing must not be copyrighted or be in the process of becoming copyrighted.

OFFERS

If you receive at least one bid over your minimum price, it is appropriate to sell the item.

FRAUD

TextSales, Inc. reserves the right to suspend or terminate your account if we suspect that you have engaged in fraudulent activities in connection with NGCSUBOOKS.COM.

MANIPULATION

Under no circumstances may you, the bidder or seller, manipulate the price of any item or interfere with any other user’s listings or transactions.

FEEDBACK

TextSales, Inc. encourages all users to give genuine and accurate feedback to other users with whom they perform transactions.  This is the only method used to assess credibility of a user of NGCSUBOOKS.COM.  Feedback is rated on a 1 through 5 star scale.  Your account may become suspended or terminated if you continuously receive extremely low feedback.

PRIVACY

We feel that the privacy of our users is a very important matter.  As a result, TextSales, Inc. does not sell or rent personal information to any third parties without your explicit consent.  We will only use your information as described in the privacy policy.

ADVERTISEMENT AND LINKS

TextSales, Inc., third party, or advertisements may provide links to other sites or resources on the Internet.  We have no control over such sites and resources and you agree that textSales, Inc. is not responsible for the availability of such external sites or resources. TextSales, Inc. does not endorse and cannot be held responsible or liable for any content, advertising, or other material on or available from these sites or resources.  You agree that TextSales, Inc. is not responsible or liable, directly or indirectly, for damages or losses from these sites or resources.

LEGAL COMPLIANCE

You shall comply with all applicable domestic, state, federal and international laws, statues, ordinances, and regulations regarding your use of our service.  This also includes bidding on, listing, purchasing, solicitation of offers for purchase, and sale of items.

TERMINATION

You agree that TextSales, Inc. reserves the right and may, under certain circumstances and without prior notice, immediately terminate your account.  If your membership has been terminated, you will be denied access from using our site and services and cannot re-register, this includes under a different username.
